19 U.S.C. § 2610 — Evidentiary requirements

In a forfeiture case under this chapter, the United States must prove that covered archaeological material was listed as required or that cultural property was inventoried by and stolen from a qualifying institution after the applicable later date.
Despite section 1615, in a chapter forfeiture case where someone claims the material or article, the United States must prove (1) for section 2606 material, that the Secretary listed it under section 2604; and (2) for a section 2607 article, that (A) it was documented in the inventory of a museum, religious or secular public monument, or similar State Party institution, and (B) it was stolen from that institution after the later of this chapter's effective date or the Convention's entry into force for that State Party.
Notwithstanding the provisions of section 1615 of this title, in any forfeiture proceeding brought under this chapter in which the material or article, as the case may be, is claimed by any person, the United States shall establish—
in the case of any material subject to the provisions of section 2606 of this title, that the material has been listed by the Secretary in accordance with section 2604 of this title; and
in the case of any article subject to section 2607 of this title, that the article—
is documented as appertaining to the inventory of a museum or religious or secular public monument or similar institution in a State Party, and
was stolen from such institution after the effective date of this chapter, or after the date of entry into force of the Convention for the State Party concerned, whichever date is later.
