The Trade Representative must designate as a major wine trading country a foreign country or economic union that could be a significant United States-wine market and maintains barriers or other trade distortions. The decision must consider listed reports, later actions, and industry or other information.

(a) The Trade Representative must designate each foreign country, or economic-union group, as a major wine trading country if the Representative judges that it (1) is a potential significant market for United States wine and (2) maintains tariff barriers, nontariff barriers, or other distortions affecting trade in United States wine. (b) In deciding whether the condition in (a)(2) exists, the Representative must consider (1) the review and report required by section 854(a) of the Trade Agreements Act of 1979; (2) relevant actions the country or group has taken since that review; and (3) information submitted under section 2805 by United States wine and grape-products industries and information from other sources.
