Each agency must assess how Federal regulatory actions affect State, local, and tribal governments and the private sector, unless another law forbids that assessment. This requirement does not apply to the extent the regulation simply includes requirements specifically stated in a law.
Each agency must, unless another law forbids it, assess the effects of Federal regulatory actions on State, local, and tribal governments and on the private sector. This does not apply to the extent the regulation incorporates requirements that a law specifically sets out.
Each agency shall, unless otherwise prohibited by law, assess the effects of Federal regulatory actions on State, local, and tribal governments, and the private sector (other than to the extent that such regulations incorporate requirements specifically set forth in law).
