2 U.S.C. § 1805 — Deputy Architect of the Capitol

The Architect of the Capitol must appoint a Deputy Architect within the stated deadline, set the Deputy’s pay, and notify Congress if the position becomes vacant. If the Architect misses the deadline, a congressional commission appoints the Deputy.
(a) The Architect of the Capitol (the “Architect”) must appoint a suitable person as Deputy Architect of the Capitol (the “Deputy Architect”). The Architect may delegate necessary or appropriate duties to the Deputy. (b) The Architect must appoint the Deputy within 120 days after (1) the Architect’s appointment under section 1801a, if no Deputy exists then, or (2) a vacancy in the Deputy’s office. (c) The Architect sets the Deputy’s annual pay, but it may not be more than $1,500 below the Architect’s annual pay. (d) If the Architect does not appoint the Deputy by the applicable date, the congressional commission described in section 1801a(a) must appoint one by majority vote. (e) If the office becomes vacant, the Architect must immediately notify the commission members.
The Architect of the Capitol (in this section referred to as the “Architect”) shall appoint a suitable individual to be the Deputy Architect of the Capitol (in this section referred to as the “Deputy Architect”). The Architect may delegate to the Deputy Architect such duties as the Architect determines are necessary or appropriate.
The Architect shall appoint a Deputy Architect under subsection (a) not later than 120 days after—
the date on which the Architect is appointed under section 1801a of this title, if there is no Deputy Architect on the date of the appointment; or
the date on which a vacancy arises in the office of the Deputy Architect.
The Deputy Architect shall be paid at an annual rate of pay to be determined by the Architect but not to exceed $1,500 less than the annual rate of pay for the Architect.
If the Architect does not appoint a Deputy Architect on or before the applicable date specified in subsection (b), the congressional commission described in section 1801a(a) of this title shall appoint the Deputy Architect by a majority vote of the members of the commission.
If the position of Deputy Architect becomes vacant, the Architect shall immediately notify the members of the congressional commission described in section 1801a(a) of this title.
