Congress finds that historically Black colleges and universities have advanced equal educational opportunity but have faced discrimination in land, financial resources, grants, contracts, and other Federal programs. It identifies physical facilities, financial management, academic resources, and endowments as appropriate forms of assistance.

Congress finds that: (1) historically Black colleges and universities have made major contributions toward equal postsecondary opportunity for Black, low-income, and educationally disadvantaged Americans; (2) States and the Federal Government discriminated in allocating land and money to Black public institutions under the Morrill Act of 1862 and related laws, and against public and private Black colleges and universities in Federal grants, contracts, and resources; (3) that discrimination partly caused the current condition of those institutions, and improving Black postsecondary institutions is needed for their continuation and participation in the Federal equality-of-opportunity mission; and (4) assistance for their physical facilities, financial management, academic resources, and endowments is appropriate to strengthen them, reduce reliance on government support, and encourage reliance on endowments and private sources.
