20 U.S.C. § 1063e — President’s Board of Advisors on HBCUs

(a) Administration. (1) The President’s Board of Advisors on Historically Black Colleges and Universities is established in the Department of Education, or in the Executive Office of the President if the President chooses. (2) Unless (3) applies, the Secretary must provide funding and administrative support, subject to appropriations. (3) If located in the Executive Office of the President, that office provides the funding and support, also subject to appropriations. (b) Membership. (1) The President may appoint no more than 23 members. The Secretary and Executive Director, or their designees, serve as nonvoting ex officio members. (2) The President names one member as Chair. The Chair helps direct the Board’s work with the Secretary and after consulting the Executive Director, and consults the Executive Director about meeting times and places. Meetings must occur at least every six months. To the extent the Federal Advisory Committee Act applies, the Chair performs the President’s functions under that Act, except congressional reporting, under General Services Administration guidelines. (3) Members receive no pay but may be reimbursed for authorized travel costs, including per diem instead of subsistence. (c) Mission and functions. Through the White House Initiative, the Board advises the President on strengthening HBCU educational capacity. Its work includes improving HBCU identity, visibility, distinctive abilities, and competitiveness; engaging philanthropic, business, government, military, homeland-security, and education communities in a national discussion of new HBCU programs; helping HBCUs remain financially secure and support national education goals and all Americans; increasing public awareness and appreciation of HBCUs; encouraging public-private investment; and improving government-wide strategic planning so Federal resources and decisions about partnerships, investments, performance goals, priorities, workforce development, and budgets support HBCU competitiveness. (d) Report. The Board must report to the President each year on its progress in performing these duties.
