A State receiving funds under this chapter must keep its related rules consistent with the chapter, identify extra State requirements in writing, and reduce the number of rules imposed on local agencies and schools. State policies must support local improvement for children with disabilities.
(a) Rulemaking. Each State* receiving funds under this chapter must (1) ensure that its rules, regulations, and policies concerning this chapter serve the chapter’s purposes; (2) tell local educational agencies in the State and the Secretary* in writing which such rules, regulations, or policies are State-imposed requirements not required by this chapter or federal regulations; and (3) minimize the number of such rules, regulations, and policies imposed on local educational agencies and schools.
(b) Support. State rules, regulations, and policies under this chapter must support and facilitate improvement of systems at the local educational-agency and school levels so children with disabilities can meet the State’s challenging academic achievement standards.
Each State* that receives funds under this chapter shall—
ensure that any State rules, regulations, and policies relating to this chapter conform to the purposes of this chapter;
identify in writing to local educational agencies located in the State and the Secretary* any such rule, regulation, or policy as a State-imposed requirement that is not required by this chapter and Federal regulations; and
minimize the number of rules, regulations, and policies to which the local educational agencies and schools located in the State are subject under this chapter.
State rules, regulations, and policies under this chapter shall support and facilitate local educational agency* and school-level system improvement designed to enable children with disabilities to meet the challenging State student academic achievement standards.
