submitted 54 years ago by Pub. L. 92-318 to r/title-20-EDUCATION · 130 words · no verdicts yet
This section makes agency actions under section 1682 reviewable under the ordinary rules for similar agency actions. It gives judicial review under the Administrative Procedure Act for otherwise unreviewable termination or refusal of education assistance.
An action by a department or agency under section 1682 is subject to whatever judicial review the law provides for similar action by that department or agency on other grounds. If an action terminating or refusing to grant or continue financial assistance for noncompliance with a section 1682 requirement is otherwise not reviewable, any aggrieved person, including a State, political subdivision, or agency, may seek review under chapter 7 of title 5. The action is not treated as committed to unreviewable agency discretion under section 701 of title 5.
Any department or agency action taken pursuant to section 1682 of this title shall be subject to such judicial review as may otherwise be provided by law for similar action taken by such department or agency on other grounds. In the case of action, not otherwise subject to judicial review, terminating or refusing to grant or to continue financial assistance upon a finding of failure to comply with any requirement imposed pursuant to section 1682 of this title, any person aggrieved (including any State or political subdivision thereof and any agency of either) may obtain judicial review of such action in accordance with chapter 7 of title 5, and such action shall not be deemed committed to unreviewable agency discretion within the meaning of section 701 of that title.
