20 U.S.C. § 4012 — Asbestos hazard abatement program

This section establishes EPA’s Asbestos Hazards Abatement Program. It requires the Administrator to gather and distribute asbestos information, provide application information, and decide financial-assistance applications.
(a) Abatement program. An EPA program called the “Asbestos* Hazards Abatement Program” is established. This subchapter calls it the “Program.”
(b) Duties. The Administrator’s duties include (1) compiling medical, scientific, and technical information about (A) asbestos health and safety hazards, (B) identifying, sampling, and testing suspected materials, and (C) reducing threats from asbestos and asbestos-containing materials; (2) distributing that information in suitable forms, including pamphlets, reports, or instructions, to State* and local educational agencies and other institutions, including parent and employee organizations, for this subchapter’s activities; (3) by November 15 of each authorized year, developing and distributing applications or notifying all local educational agencies that forms are available and explaining how to obtain them; and (4) reviewing and approving or rejecting financial-assistance applications under section 4014.
There is hereby established a program within the Environmental Protection Agency to be known as the Asbestos* Hazards Abatement Program (hereinafter in this subchapter referred to as “Program”).
The duties of the Administrator* in implementing and effectuating the Program shall include—
the compilation of medical, scientific, and technical information including, but not limited to—
the health and safety hazards associated with asbestos materials;
the means of identifying, sampling, and testing materials suspected of emitting asbestos fibers; and
the means of abating the threat* posed by asbestos and asbestos containing materials;
the distribution of the information described in paragraph (1) (in any appropriate form such as pamphlets, reports, or instructions) to State* and local educational agencies and to other institutions, including parent and employee organizations, for the purpose of carrying out activities described in this subchapter;
not later than November 15 of each year for which this subchapter is authorized, the development and distribution of applications, or notifications to all local educational agencies of the availability of application forms including information for obtaining such forms; and
the review of applications for financial assistance, and the approval or disapproval of such applications, in accordance with the provisions of section 4014 of this title.
