submitted 24 years ago by Pub. L. 89-10 to r/title-20-EDUCATION · 298 words · no verdicts yet
This section addresses program evaluations. It sets the rules stated in the section.
(a) Scope of evaluation. Every State agency or local educational agency running a program under subpart 1 or 2 must evaluate it at least once every 3 years. It must break participation data down by gender, race, ethnicity, and age while protecting student privacy. The evaluation must measure the program's effect on participants' ability to improve achievement and graduate within the State's four-year or, when applicable, extended-year adjusted cohort rate; earn credits meeting State promotion and graduation requirements; move to a regular or other education program run by a local agency or a Bureau of Indian Education school; finish high school or high-school-equivalency requirements and get work after leaving a correctional facility or an institution for neglected or delinquent children and youth*; and, when appropriate, join postsecondary education and job-training programs. (b) Exception. Data need not be broken down when a category has too few students for statistically reliable information or the breakdown would reveal a student's identity. (c) Evaluation measures. Each evaluation must use multiple appropriate measures of student progress. (d) Evaluation results. Each State agency and local educational agency must send the results to the State educational agency and the Secretary, and must use them to plan and improve later programs for participating children and youth.
Each State agency or local educational agency that conducts a program under subpart 1 or 2 of this part shall evaluate the program, disaggregating data on participation by gender, race, ethnicity, and age while protecting individual student privacy,,1 not less than once every 3 years, to determine the program’s impact on the ability of participants—
to maintain and improve educational achievement and to graduate from high school in the number of years established by the State under either the four-year adjusted cohort graduation rate or the extended-year adjusted cohort graduation rate, if applicable;
to accrue school credits that meet State requirements for grade promotion and high school graduation;
to make the transition to a regular program or other education program operated by a local educational agency or school operated or funded by the Bureau of Indian Education;
to complete high school (or high school equivalency requirements) and obtain employment after leaving the correctional facility or institution for neglected or delinquent children and youth*; and
as appropriate, to participate in postsecondary education and job training programs.
The disaggregation required under subsection (a) shall not be required in a case in which the number of students in a category is insufficient to yield statistically reliable information or the results would reveal personally identifiable information about an individual student.
In conducting each evaluation under subsection (a), a State agency or local educational agency shall use multiple and appropriate measures of student progress.
Each State agency and local educational agency shall—
submit evaluation results to the State educational agency and the Secretary; and
use the results of evaluations under this section to plan and improve subsequent programs for participating children and youth.
