20 U.S.C. § 7474 — Minimum grant criteria

The Secretary can only approve grants, contracts, or agreements under two parts of the law if they meet two tests. First, the project must be big enough and good enough to reach its goals. Second, it must be based on real research findings.
The Secretary of Education cannot approve an application for a grant, contract, or cooperative agreement under subpart 2 or subpart 3 of this part unless the application is for something that is (1) of sufficient size, scope, and quality to achieve its purpose or goals, and (2) based on relevant research findings.
The Secretary may not approve an application for a grant, contract, or cooperative agreement under subpart 2 or subpart 3 of this part unless the application is for a grant, contract, or cooperative agreement that is—
of sufficient size, scope, and quality to achieve the purpose or objectives of such grant, contract, or cooperative agreement; and
based on relevant research findings.
