This section defines key terms for the Pro-Children Act. "Children" means anyone under 18. "Children's services" covers routine health, day care, education, or library services that receive certain federal funding.

This section defines terms used throughout this subpart. (1) Children. Anyone who has not yet turned 18. (2) Children's services. Routine or regular health, day care, education, or library services that are either (A) funded, after January 8, 2002, directly by the federal government or through state or local governments, by a federal grant, loan, loan guarantee, or contract program run by the Secretary of Health and Human Services or the Secretary of Education — except services funded solely under Medicare and Medicaid (Social Security Act titles XVIII and XIX) — or run by the Secretary of Agriculture for a clinic (as defined in 7 C.F.R. Part 246.2) under section 17(b)(6) of the Child Nutrition Act of 1966; or (B) provided in indoor facilities that were built, run, or kept up using that kind of federal money, as decided by the relevant federal agency head when enforcing this subpart — except that this doesn't cover facilities, other than clinics, where people redeem coupons under the Child Nutrition Act of 1966. (3) Indoor facility. A building that is enclosed. (4) Person. Any state or local government subdivision, agency of one, corporation, or partnership that owns, runs, or otherwise controls and provides children's services — or any individual who does the same. (5) Secretary. The Secretary of Health and Human Services.
