21 U.S.C. § 1710a — Requirement for disclosure of Federal sponsorship of all Federal advertising or other communication materials

The Office must clearly disclose when it pays for an advertisement or other communication. The section defines those communications broadly.
(a) Each advertisement or other communication paid for by the Office, directly or through an Office contract, must prominently tell its target audience that the Office paid for it. (b) “Advertisement or other communication,” which this section does not otherwise define, includes (1) an advertisement distributed in any form, including print or electronic form, and (2) a communication by an individual in any form, including speech, print, or electronic form.
Each advertisement or other communication paid for by the Office, either directly or through a contract awarded by the Office, shall include a prominent notice informing the target audience that the advertisement or other communication is paid for by the Office.
In this section, the term “advertisement or other communication” includes—
an advertisement disseminated in any form, including print or by any electronic means; and
a communication by an individual in any form, including speech, print, or by any electronic means.
