21 U.S.C. § 954 — Transshipment and in-transit shipment of controlled substances

This section creates exceptions to the usual import and export rules for controlled substances being moved through the United States. Schedule I substances need the Attorney General’s prior written approval; schedule II, III, and IV substances require advance notice under regulations.
Despite sections 952, 953, and 957: (1) A schedule I controlled substance may be imported into the United States for transshipment to another country, or moved from one vessel, vehicle, or aircraft to another in the United States for immediate export, only if it is for scientific, medical, or another legitimate purpose in the destination country and the Attorney General gave prior written approval. The Attorney General must approve or deny the request within 21 days. (2) A schedule II, III, or IV controlled substance may be imported, transferred, or transshipped in the same way only if advance notice is given to the Attorney General under the Attorney General’s regulations.
Notwithstanding sections 952, 953, and 957 of this title—
A controlled substance in schedule I may—
be imported into the United States for transshipment to another country, or
be transferred or transshipped from one vessel, vehicle, or aircraft to another vessel, vehicle, or aircraft within the United States for immediate exportation,
if and only if it is so imported, transferred, or transshipped (i) for scientific, medical, or other legitimate purposes in the country of destination, and (ii) with the prior written approval of the Attorney General (which shall be granted or denied within 21 days of the request).
A controlled substance in schedule II, III, or IV may be so imported, transferred, or transshipped if and only if advance notice is given to the Attorney General in accordance with regulations of the Attorney General.
