The Secretary of State must prevent specified foreign agents and weapons-related persons from participating in educational and cultural exchanges. The section defines “appropriate executive branch officials” and “agent of a foreign power” by reference to other laws.

(a) With other appropriate executive officials, the State Secretary must take all appropriate steps to: (1) keep every agent of a foreign power out of educational and cultural exchange programs under this chapter; (2) keep out a person involved in researching, developing, designing, testing, evaluating, or producing missiles or weapons of mass destruction if employed by or attached to an entity in a country identified within the previous five years by a United States intelligence-community element as involved in spreading such weapons; and (3) keep out anyone involved in researching, developing, designing, testing, evaluating, or producing chemical or biological weapons for offensive purposes.
(b)(1) “Appropriate executive branch officials” means officials from the United States Government elements listed under section 101 of the Intelligence Authorization Act for Fiscal Year 1999 (Public Law 105–272). (2) “Agent of a foreign power” has the meaning in 50 U.S.C. § 1801(b)(1)(B) and (b)(2), but does not include a person acting in the capacity described in § 1801(b)(1)(A).
