A Federal agency may separate an employee who accepts a Mansfield fellowship and is not detailed. Nondetailee fellows have reemployment rights and specified rights and benefits, and the Center must reimburse agencies for certain costs subject to appropriations.

(a) Separation. Under terms and conditions set by the agency head, a United States agency may separate an officer or employee for a specified period if the person accepts a fellowship under this chapter and is not detailed under section 6104. (b) Reemployment. At the fellowship’s end, a nondetailee fellow is entitled to reemployment in the same way as if covered by section 3582 of title 5; this section does not define that coverage. (c) Rights and benefits. Despite sections 8347(o), 8713, and 8914 of title 5, and under Office of Personnel Management regulations, a nondetailee employee serving as a fellow has the same rights and benefits as if covered by section 3582 of title 5. The Center must reimburse the employing agency for costs under that section. (d) Compliance with Budget Act. Funds are available under this section only to the extent and in the amounts provided in appropriation Acts.
