22 U.S.C. § 7841 — United States policy toward refugees and defectors

(a) Report. Within 120 days after October 18, 2004, the Secretary of State had to work with other federal agencies and send a report to Congress. The report had to describe the situation of North Korean refugees and explain U.S. government policy toward North Koreans outside North Korea. (b) Contents. The report had to include: (1) An assessment of what North Korean refugees and migrants face while hiding, especially in China, and what happens to them if they are sent back to North Korea. (2) An assessment of whether North Koreans in China can actually reach staff from the United Nations High Commissioner for Refugees (UNHCR), and whether China is meeting its duties under the 1951 Convention Relating to the Status of Refugees — especially Articles 31, 32, and 33 of that treaty. (3) An assessment of whether North Koreans currently have unblocked access to U.S. refugee and asylum processing, and an explanation of U.S. policy toward North Koreans who show up at U.S. embassies or consulates asking for protection as refugees or asylum seekers and resettlement in the United States. (4) The total number of North Koreans admitted to the United States as refugees or asylees in each of the past five years. (5) An estimate of how many North Koreans have family ties to U.S. citizens. (6) A description of what the Secretary of State is doing to carry out section 7843 of this title. (c) Form. The information for items (1) through (5) of subsection (b) must be unclassified. All or part of the information for item (6) may be classified, if that is necessary.
