22 U.S.C. § 8794 — Waiver

This section lets the President waive adding a person to a required list or imposing sanctions under section 8791, 8792, or 8793. The President must find that the waiver serves the United States’ national-security interests and send the appropriate congressional committees a report explaining that finding.
The President may waive either of these requirements: adding a person to a list required by section 8791, 8792, or 8793 of this title, or imposing sanctions under any of those sections. The President may do so only if— (1) the President determines that the waiver is in the national-security interests of the United States; and (2) the President sends the appropriate congressional committees a report explaining why the President made that determination. This section does not define “appropriate congressional committees.”
The President may waive the requirement to include a person on a list required by section 8791, 8792, or 8793 of this title or to impose sanctions pursuant to any such section if the President—
determines that such a waiver is in the national security interests of the United States; and
submits to the appropriate congressional committees a report on the reasons for that determination.
