23 U.S.C. § 302 — State transportation department

A state must have a transportation department to use this title's programs. That department needs enough power and staff, and may hire private firms to help. Following this rule does not change whether particular costs qualify for funding.
(a) Any state* that wants to use the programs in this title must have its own state transportation department*. That department must have enough legal power, and be properly staffed and organized, to satisfy the Secretary* that it can carry out this title's duties. To meet this requirement, a state may hire private engineering firms as much as it needs.
(b) Effect of Compliance. Meeting the requirement in subsection (a) has no effect on whether particular costs are eligible for federal funding — the two things are judged separately.
Any State* desiring to avail itself of the provisions of this title shall have a State transportation department* which shall have adequate powers, and be suitably equipped and organized to discharge to the satisfaction of the Secretary* the duties required by this title. In meeting the provisions of this subsection, a State may engage, to the extent necessary or desirable, the services of private engineering firms.
Compliance with subsection (a) shall have no effect on the eligibility of costs.
