23 U.S.C. § 406 — General requirements for Federal assistance

(a) Definition of Funded Project. A "funded project" is any project that gets money, in whole or in part, from a grant under section 402 or 405. (b) Regulatory Authority. Every funded project must follow the regulations the Secretary issues. (c) State Matching Requirements. If a grant under this chapter requires a state to share the cost, then whatever the state (or its political subdivisions) spends on highway safety activities during a fiscal year — not counting federal funds, and not counting spending on planning or administration — counts toward the state's required share of the cost of any other funded project that same year. This credit applies even if the spending wasn't specifically tied to that other project. (d) Grant Application and Deadline. (1) To get a grant under this chapter, a state must submit an application, in the form, manner, and with the information the Secretary requires. (2) The Secretary must set one single deadline for applications, so grants can be given out early in the fiscal year that follows. (e) Distribution of Funds to States. Within 60 days after the fiscal year starts, or after Congress passes the appropriations law funding this chapter — whichever is later — the Secretary must distribute to each state its share of the funds for that year.
