25 U.S.C. § 1404 — Hearing transcripts and tribal support statements; submission to Congress with plan

When the Secretary submits an Indian judgment funds plan to Congress, the Secretary must also submit the hearing transcripts and other materials used to prepare it. The Secretary must explain how the plan reflects tribal or individual wishes and identify and measure support for alternatives.
When submitting the plan under section 1402, the Secretary* must also submit to Congress (1) transcripts of hearings about the Indian judgment held under section 1403(a)(2), and all other papers and documents considered in preparing the plan, including the tribe’s resolutions, communications, and proposed use or distribution plans submitted under section 1403(a)(1); and (2) a statement explaining how much the plan reflects the wishes of the tribe or people entitled to the funds. The statement must identify any alternatives those people or the tribe proposed instead of the plan and indicate the degree of support among interested parties for each alternative.
When submitting the plan as provided in section 1402 of this title, the Secretary* shall also submit to the Congress with such plan—
copies of the transcripts of hearings held by him concerning the Indian judgment pursuant to clause (2) of section 1403(a) of this title and all other papers and documents considered by him in the preparation of such plan, including any resolution, communication, or suggested use or distribution plan of the pertinent Indian tribe* submitted pursuant to clause (1) of section 1403(a) of this title; and
a statement of the extent to which such plan reflects the desires of the Indian tribe or individuals who are entitled to such funds, which statement shall specify the alternatives, if any, proposed by such Indian tribe or individuals in lieu of such plan, together with an indication of the degree of support among the interested parties for each such alternative.
