The Secretary must submit Congress a plan within one year describing how and when a separate Nevada Area Office could be created. If the plan is late, the Secretary must withhold specified Office of the Director operations funds without harming health-care capacity, though the Secretary may later restore them after compliance.
(a) In general. Within one year after March 23, 2010, and consistently with the Service’s tribal-consultation policy, the Secretary* must submit Congress a plan describing how and when a separate area office*, distinct from the Phoenix Area Office, could be established in Nevada.
(b) Failure to submit plan. (1) “Operations funds” means only funds used for: (A) administering services, including overtime, personnel salaries, and related benefits; or (B) related tasks that directly affect those operations. (2) If the Secretary does not submit the subsection (a) plan, the Secretary must withhold operations funds reserved for the Office of the Director, but the withholding may not harm the Service’s capacity to deliver health care. (3) The Secretary may restore the withheld funds to the Office of the Director when that office complies with this section.
Not later than 1 year after March 23, 2010, in a manner consistent with the tribal consultation policy of the Service*, the Secretary* shall submit to Congress a plan describing the manner and schedule by which an area office*, separate and distinct from the Phoenix Area Office of the Service, can be established in the State of Nevada.
In this subsection, the term “operations funds” means only the funds used for—
the administration of services, including functional expenses such as overtime, personnel salaries, and associated benefits; or
related tasks that directly affect the operations described in subparagraph (A).
If the Secretary fails to submit a plan in accordance with subsection (a), the Secretary shall withhold the operations funds reserved for the Office of the Director, subject to the condition that the withholding shall not adversely impact the capacity of the Service to deliver health care services.
The operations funds withheld pursuant to paragraph (2) may be restored, at the discretion of the Secretary, to the Office of the Director on achievement by that Office of compliance with this section.
