25 U.S.C. § 1804 — Eligible grant recipients

A tribally controlled college or university qualifies for assistance only if an Indian-majority board governs it, it serves Indian needs, it has an Indian-majority student body after its first year, and it is accredited or making reasonable progress toward accreditation.
To qualify for assistance, a tribally controlled college or university must: (1) be governed by a board of directors or trustees with a majority of Indians; (2) follow stated goals, a philosophy, or an operating plan directed at meeting Indians’ needs; (3) if operating more than one year, have a majority-Indian student body; and (4)(A) be accredited by a nationally recognized accrediting agency or association that the Secretary* of Education finds reliable about training quality, or (B) according to such an agency or association, be making reasonable progress toward accreditation. This section does not define “Indian,” “tribally controlled,” “nationally recognized,” or “reasonable progress.”
To be eligible for assistance under this subchapter, a tribally controlled college or university must be one which—
is governed by a board of directors or board of trustees a majority of which are Indians;
demonstrates adherence to stated goals, a philosophy, or a plan of operation which is directed to meet the needs of Indians;
if in operation for more than one year, has students a majority of whom are Indians; and
is accredited by a nationally recognized accrediting agency or association determined by the Secretary* of Education to be a reliable authority with regard to the quality of training offered; or
according to such an agency or association, is making reasonable progress toward accreditation.
