This section directs the Indian Health Service to create standardized sexual-assault policies and procedures for its facilities, using Justice Department procedures as a model and consulting specified tribal and urban Indian organizations.
The Director of the Indian Health Service, working with the Directors of the Office of Justice Services and the Department of Justice’s Office on Violence Against Women, must develop standardized sexual-assault policies and procedures for Service facilities. The Director must consult Indian Tribes and Tribal Organizations and confer with Urban Indian Organizations. The policies and procedures must be based on similar procedures established by the Department of Justice.
The Director of the Indian Health Service, in coordination with the Director of the Office of Justice Services and the Director of the Office on Violence Against Women of the Department of Justice, in consultation with Indian Tribes and Tribal Organizations, and in conference with Urban Indian Organizations, shall develop standardized sexual assault policies and protocol for the facilities of the Service, based on similar protocol that has been established by the Department of Justice.
