25 U.S.C. § 356 — Allowance of undisputed claims of restricted allottees of Five Civilized Tribes

Normally, claims against a restricted allottee's individual money, or leases of a restricted allottee's land, might be sent to the Secretary of the Interior for approval. This section removes that step for two kinds of matters. First: undisputed claims to be paid from the individual money of restricted allottees of the Five Civilized Tribes, or their heirs. Second: uncontested agricultural and mineral leases made by individual restricted Indian allottees, or their heirs — except oil and gas leases, which this section excludes. These undisputed claims and uncontested leases are not forwarded to the Secretary of the Interior for approval. Instead, the Superintendent for the Five Civilized Tribes of Oklahoma pays, approves, rejects, or disapproves them directly. If any party is aggrieved by a decision or order the Superintendent makes on one of these matters, that party may appeal the decision or order to the Secretary of the Interior. The appeal must be filed within thirty days from the date of the Superintendent's decision or order.
