The Secretary of the Interior can pay tribal heirs up to $500 in deposited funds. This applies only if the person owned no land, or their land was already sold. These disbursements are not taxable.

The Secretary of the Interior can pay out money — up to $500 — that's on deposit for a deceased Five Civilized Tribes member, to that person's heirs or the people named in their will. This only works if the decedent owned no land when they died, or if any land they had has since been legally sold or transferred. The Secretary pays the money once satisfied by proof of the person's death and who the rightful heirs or legatees are, and the Secretary's decision on that is final. Transferring these funds this way is not taxed.
