25 U.S.C. § 414 — Reservation of minerals in sale of Choctaw-Chickasaw lands

Since August 25, 1937, the Secretary of the Interior can sell Choctaw and Chickasaw tribal lands in Oklahoma. The Secretary can keep the mineral rights, including oil and gas, for the tribes. The Secretary decides this only when it best serves the tribes' interests.
Starting on August 25, 1937, this law lets the Secretary* of the Interior sell tribal lands belonging to the Choctaw and Chickasaw Indians in Oklahoma. These are lands that other existing laws already allow to be sold.
When the Secretary sells this land, the Secretary can hold back the mineral rights instead of selling them along with the land. That includes oil and gas rights. The Secretary keeps these mineral rights for the benefit of the Choctaw and Chickasaw people.
The Secretary only reserves the minerals when the Secretary judges that doing so best serves the interests of the Indians.
On and after August 25, 1937, in all sales of tribal lands of the Choctaw and Chickasaw Indians in Oklahoma provided for by existing law, the Secretary* of the Interior is hereby authorized to offer such lands for sale subject to a reservation of the mineral rights therein, including oil and gas, for the benefit of said Indians, whenever in his judgment the interests of the Indians will best be served thereby.
