25 U.S.C. § 5393 — Budget request

(a) Requirement of annual budget request. (1) The President must identify in the annual budget request under section 1105 of title 31 all money needed to fully fund every funding agreement authorized by this subchapter, including money specifically identified for tribal base budgets. Congress-appropriated funds must be apportioned to the Indian Health Service and given to the Office of Tribal Self-Governance^*, which must distribute funds provided under section 5385. (2) This does not authorize the Indian Health Service to reduce money a self-governance tribe is otherwise entitled to under its funding agreement or other applicable law, whether or not the money is apportioned to the Office.

(b) Present funding; shortfalls. The budget request must identify, for each Indian tribe^*, the level of need currently funded and every funding shortfall, including direct program and contract-support costs. It must do so for services provided directly by the Secretary^* of Health and Human Services, under self-determination contracts, or under compacts and funding agreements authorized by this subchapter.
