Unless the petition proceeding ended on a dismissal motion, the agency must file the review record with the clerk as section 2112 requires.
Unless the proceeding ended because the petition was dismissed on motion, the agency* must file the record on review with the clerk as section 2112 of this title provides.
Unless the proceeding has been terminated on a motion to dismiss the petition, the agency* shall file in the office of the clerk the record on review as provided by section 2112 of this title.
