Eligible citizens or subjects of foreign governments may sue the United States in the Court of Federal Claims if their government allows United States citizens to bring claims in its courts. The claim must otherwise fit that court’s jurisdiction, subject to a tax-suit exception.
(a) A citizen or subject of a foreign government that gives United States citizens the right to prosecute claims against that government in its courts may sue the United States in the Court of Federal Claims if the subject is otherwise within that court’s jurisdiction. (b) Section 7422(f) of the Internal Revenue Code of 1986 provides an exception for suits involving internal revenue taxes.
Citizens or subjects of any foreign government which accords to citizens of the United States the right to prosecute claims against their government in its courts may sue the United States in the United States Court of Federal Claims if the subject matter of the suit is otherwise within such court’s jurisdiction.
