This chapter defines defamation, domestic and foreign courts, foreign judgments, States, and United States persons. A United States person includes specified citizens, residents, people lawfully residing here when speech was handled, and United States businesses.
In this chapter: (1) “Defamation” means an action or proceeding for defamation, libel, slander, or a similar claim alleging speech was false, harmed reputation or caused emotional distress, put someone in a false light, or led to criticism, dishonor, or condemnation. (2) “Domestic court” means a Federal or State court. (3) “Foreign court” means a foreign country’s court, administrative body, or tribunal. (4) “Foreign judgment” means a final judgment from a foreign court. (5) “State” means any State, the District* of Columbia, or any United States commonwealth, territory, or possession. (6) “United States person” means (A) a United States citizen; (B) an alien lawfully admitted for permanent residence; (C) an alien lawfully residing in the United States when the speech involved was researched, prepared, or disseminated; or (D) a business incorporated in, or primarily located or operating in, the United States.
In this chapter:
The term “defamation” means any action or other proceeding for defamation, libel, slander, or similar claim alleging that forms of speech are false, have caused damage to reputation or emotional distress, have presented any person in a false light, or have resulted in criticism, dishonor, or condemnation of any person.
The term “domestic court” means a Federal court or a court of any State.
The term “foreign court” means a court, administrative body, or other tribunal of a foreign country.
The term “foreign judgment” means a final judgment rendered by a foreign court.
The term “State” means each of the several States, the District* of Columbia, and any commonwealth, territory, or possession of the United States.
The term “United States person” means—
a United States citizen;
an alien lawfully admitted for permanent residence to the United States;
an alien lawfully residing in the United States at the time that the speech that is the subject of the foreign defamation action was researched, prepared, or disseminated; or
a business entity incorporated in, or with its primary location or place of operation in, the United States.
