29 U.S.C. § 1856 — Waiver of rights

This section generally voids employee agreements that waive or change rights under this chapter. An agreement favoring the Secretary is valid when used to enforce the chapter.
An employee agreement that claims to waive or change the employee’s rights under this chapter is void because it conflicts with public policy. A waiver or change that favors the Secretary* is valid for enforcing this chapter.
Agreements by employees purporting to waive or to modify their rights under this chapter shall be void as contrary to public policy, except that a waiver or modification of rights in favor of the Secretary* shall be valid for purposes of enforcement of this chapter.
