29 U.S.C. § 216bLiability for overtime work performed prior to July 20, 1949

This law protects employers from liability for overtime pay disputes from before July 20, 1949. It applies if the employer already paid at least as much as the newer overtime formula would have required.

This is one undivided savings provision. No employer can be held liable or punished under the Fair Labor Standards Act — in any action or proceeding started before, on, or after January 24, 1950 — solely because the employer failed to pay an employee for overtime work performed before July 20, 1949. This protection applies as long as whatever compensation the employer actually paid before July 20, 1949, for that work was at least equal to what would have been payable if section 7(d)(6) and (7) and section 7(g) of the Fair Labor Standards Act had already been in effect when the payment was made.
