3 U.S.C. § 104Salary of the Vice President

submitted 78 years ago by ch. 644 to r/title-3-THE-PRESIDENT · 220 words · no verdicts yet

in plain englishAI-generated · not legal advice

The Vice President's yearly salary starts at the rate set under title 2's pay rules. It then goes up whenever General Schedule federal pay rates are adjusted, by a percentage tied to the same wage-index calculation used for that adjustment, rounded to the nearest $100. That yearly increase can never be bigger than the percentage increase General Schedule pay itself gets that year.

(a) The Vice President's yearly salary is first set at the rate given for that position under chapter 11 of title 2. Then, subject to subsection (b), whenever General Schedule federal pay rates go up under section 5303 of title 5, the Vice President's salary goes up too — by an amount equal to the same percentage change in the Employment Cost Index used to figure that General Schedule adjustment, measured from the start of the fiscal year in which the pay increase takes effect. The result is rounded to the nearest $100 (rounding up if it falls exactly halfway between two multiples of $100). (b) No matter what subsection (a) would produce, the Vice President's percentage pay increase in any calendar year (before rounding) can never be more than the percentage increase that General Schedule pay rates get that same year under section 5303 of title 5.

(a)

The per annum rate of salary of the Vice President of the United States shall be the rate determined for such position under chapter 11 of title 2, as adjusted under this section. Subject to subsection (b), effective at the beginning of the first month in which an adjustment takes effect under section 5303 of title 5 in the rates of pay under the General Schedule, the salary of the Vice President shall be adjusted by an amount, rounded to the nearest multiple of $100 (or if midway between multiples of $100, to the nearest higher multiple of $100), equal to the percentage of such per annum rate which corresponds to the most recent percentage change in the ECI (relative to the date described in the next sentence), as determined under section 704(a)(1) of the Ethics Reform Act of 1989. The appropriate date under this sentence is the first day of the fiscal year in which such adjustment in the rates of pay under the General Schedule takes effect.

(b)

In no event shall the percentage adjustment taking effect under the second and third sentences of subsection (a) in any calendar year (before rounding) exceed the percentage adjustment taking effect in such calendar year under section 5303 of title 5 in the rates of pay under the General Schedule.
