30 U.S.C. § 360 — Authority to manage certain mineral leases
submitted 79 years ago by Pub. L. 102-486 to r/title-30-MINERAL-LANDS-AND-MINING · 211 words · no verdicts yet
Federal agencies that hold land with an existing mineral lease must hand over lease-management and collection authority to the Interior Secretary. Older acquisitions transfer as quickly as practical; newer ones transfer automatically at acquisition. This doesn't change any agency's existing surface-management power.
Every federal department, agency, and instrumentality that manages land the United States acquired with an existing mineral lease already on it must hand over to the Secretary of the Interior the authority to run that lease and collect all money owed to the United States under it. For land acquired on or before October 24, 1992, that transfer of authority happens as quickly as practical after that date. For land acquired after October 24, 1992, the Secretary gets that authority automatically, right when the land is acquired. Section 355's rules apply to all money collected from these leases the same way they apply to money from leases issued directly under this chapter. Here, "existing mineral lease" means any lease that was already in place when the United States acquired the land. Nothing in this section changes any federal agency's existing authority over managing the land's surface.
Each department, agency and instrumentality of the United States which administers lands acquired by the United States with one or more existing mineral lease shall transfer to the Secretary of the Interior the authority to administer such lease and to collect all receipts due and payable to the United States under the lease. In the case of lands acquired on or before October 24, 1992, the authority to administer the leases and collect receipts shall be transferred to the Secretary of the Interior as expeditiously as practicable after October 24, 1992. In the case of lands acquired after October 24, 1992, such authority shall be vested with the Secretary at the time of acquisition. The provisions of section 355 of this title shall apply to all receipts derived from such leases where such receipts are due and payable to the United States under the lease in the same manner as such provisions apply to receipts derived from leases issued under the authority of this chapter. For purposes of this section, the term “existing mineral lease” means any lease in existence at the time land is acquired by the United States. Nothing in this section shall be construed to affect the existing surface management authority of any Federal agency.
