30 U.S.C. § 41Intersecting or crossing veins

submitted date unrecorded by Congress to r/title-30-MINERAL-LANDS-AND-MINING · 83 words · no verdicts yet

in plain englishAI-generated · not legal advice

This law settles disputes when two mining claims' underground veins cross each other. Whoever staked their claim first owns the ore where the veins meet, but the later claim gets a right of way through that spot. When two veins join together, the earlier claim owns the vein below the joining point.

This section is one undivided rule about underground mining veins. When two or more veins intersect or cross each other, the claim that was located first has priority, and its owner gets all the ore or mineral found within the space where the veins cross. The owner of the later claim still gets a right-of-way through that crossing space, so they can conveniently work their own mine. When two or more veins unite instead of just crossing, the earlier or prior claim gets the combined vein below the point where they join, including the space where they intersect.

Where two or more veins intersect or cross each other, priority of title shall govern, and such prior location shall be entitled to all ore or mineral contained within the space of intersection; but the subsequent location shall have the right-of-way through the space of intersection for the purposes of the convenient working of the mine. And where two or more veins unite, the oldest or prior location shall take the vein below the point of union, including all the space of intersection.
