submitted 44 years ago by Pub. L. 97-258 to r/title-31-MONEY-AND-FINANCE · 121 words · no verdicts yet
An executive agency must use a grant agreement when its main purpose is to transfer value for an authorized public-support purpose, rather than buy property or services for the United States. This also requires that substantial agency involvement is not expected.
An executive agency must use a grant agreement as the legal instrument for its relationship with a State, local government, or other recipient when (1) the main purpose is to transfer something of value to carry out a United States-law-authorized public purpose of support or stimulation, rather than acquire property or services by purchase, lease, or barter for the direct benefit or use of the United States Government; and (2) substantial involvement between the agency and the recipient is not expected while carrying out the agreement’s activity.
An executive agency shall use a grant agreement as the legal instrument reflecting a relationship between the United States Government and a State, a local government, or other recipient when—
the principal purpose of the relationship is to transfer a thing of value to the State or local government or other recipient to carry out a public purpose of support or stimulation authorized by a law of the United States instead of acquiring (by purchase, lease, or barter) property or services for the direct benefit or use of the United States Government; and
substantial involvement is not expected between the executive agency and the State, local government, or other recipient when carrying out the activity contemplated in the agreement.
