An executive-agency head may give qualifying research institutions title to tangible personal property bought for scientific research when doing so advances the agency's objectives.
The head of an executive agency may give title to tangible personal property to a nonprofit institution of higher education or nonprofit organization whose main purpose is scientific research when: (1) the property was bought with money under a procurement contract, grant agreement, or cooperative agreement for basic or applied scientific research; (2) the agency head decides this advances agency objectives; (3) the United States has no further obligation; and (4) the agency head sets appropriate conditions.
The head of an executive agency may vest title in tangible personal property in a nonprofit institution of higher education or in a nonprofit organization whose primary purpose is conducting scientific research—
when the property is bought with amounts provided under a procurement contract, grant agreement, or cooperative agreement with the institution or organization to conduct basic or applied scientific research;
when the head of the agency decides the vesting furthers the objectives of the agency;
without further obligation to the United States Government; and
under conditions the head of the agency considers appropriate.
