The Secretary may give a non-Federal interest excess dredged material at no additional cost. The recipient must pay removal and transport costs and accept all related liability.
(1) The Secretary may provide a non-Federal interest, at no extra cost, dredged material the Secretary determines exceeds the amount needed for the Secretary’s use. (2) The non-Federal interest must pay every cost of removing and transporting it and certify responsibility for all liability connected with removal or use after removal.
The Secretary is authorized to make available to a non-Federal interest, at no additional cost, dredged material that the Secretary has determined is in excess of the amounts identified as needed for use by the Secretary.
The non-Federal interest shall be responsible for all costs to remove and transport such material, and shall certify that the non-Federal interest is responsible for any and all liability related to the removal of such material or the use of such material once it is removed.
