33 U.S.C. § 3063 — Rules and regulations when cooperating with military departments

The Secretaries of Defense and Commerce must jointly regulate NOAA’s wartime duties and peacetime cooperation with the military. The regulations need both Secretaries’ approval and may address communications.
(a) Joint regulations. The Secretaries of Defense and Commerce must jointly issue regulations (1) governing the Administration’s duties during war; and (2) providing for its peacetime cooperation with military departments in preparing for wartime duties. (b) Approval. The regulations do not take effect unless both Secretaries approve them. (c) Communications. They may establish procedures for reports and communications between a military department and the Administration*.
The Secretary* of Defense and the Secretary of Commerce shall jointly prescribe regulations—
governing the duties to be performed by the Administration* in time of war; and
providing for the cooperation of the Administration with the military departments in time of peace in preparation for its duties in time of war.
Regulations under subsection (a) shall not be effective unless approved by each of those Secretaries.
Regulations under subsection (a) may provide procedures for making reports and communications between a military department and the Administration.
