The Department of the Army, under the Secretary of the Army and Chief of Engineers, generally has jurisdiction over Federal investigations and improvements of rivers, harbors, and waterways. Those activities must also give proper attention to wildlife conservation.
Unless an Act of Congress specifically provides otherwise, the Department of the Army has jurisdiction over and must carry out Federal investigations and improvements of rivers, harbors, and other waterways. The Secretary of the Army directs this work, and the Chief of Engineers supervises it. The investigations and improvements must give proper consideration to conserving wildlife.
Federal investigations and improvements of rivers, harbors, and other waterways shall be under the jurisdiction of and shall be prosecuted by the Department of the Army under the direction of the Secretary of the Army and the supervision of the Chief of Engineers, except as otherwise specifically provided by Act of Congress, which said investigations and improvements shall include a due regard for wildlife conservation.
