This section authorizes the Assistant Attorney General to waive a State’s liability for certain grant provisions when the State lacks an adequate forum to enforce liability against Indian tribes. The Assistant Attorney General may pursue necessary legal remedies.
Where a State does not have an adequate forum to enforce grant provisions imposing liability on Indian tribes, the Assistant Attorney General is authorized to waive State liability and may pursue such legal remedies as are necessary.
