34 U.S.C. § 20920 — Public access to sex offender information through the Internet
submitted 20 years ago by Pub. L. 109-248 to r/title-34-CRIME-CONTROL-AND-LAW-ENFORCEMENT · 336 words · no verdicts yet
Jurisdictions must post sex offender registry information online, searchable by zip code. Some information must be kept private, some can be kept private at the jurisdiction's choice, and the site must include safety warnings and error-correction instructions.
(a) In general. Except as this section provides, each jurisdiction* must publish all of its sex offender registry* information on the internet, in a way that's easy for both other jurisdictions and the public to access. The jurisdiction's website must let the public search by zip code or a geographic radius the user sets, using a single query. It must also include all the field search features needed to fully take part in the Dru Sjodin National Sex Offender* Public Website, and must actually participate in that website as the Attorney General provides.
(b) Mandatory exemptions. A jurisdiction must keep these things off the public site: (1) the identity of any sex offense* victim; (2) the offender's Social Security number; (3) any arrest that didn't lead to a conviction; and (4) anything else the Attorney General exempts from disclosure.
(c) Optional exemptions. A jurisdiction may choose to keep these off the public site: (1) information about a tier I offender convicted of something other than a specified offense against a minor*; (2) the offender's employer's name; (3) the name of the offender's school; and (4) anything else the Attorney General exempts.
(d) Links. The site must, as much as practical, link to sex offender safety and education resources.
(e) Correction of errors. The site must explain how someone can ask to correct information they believe is wrong.
(f) Warning. The site must warn that the information should not be used to unlawfully injure, harass, or commit a crime against anyone listed, or anyone living or working at a listed address. The warning must note that doing so could lead to civil or criminal penalties.
Except as provided in this section, each jurisdiction* shall make available on the Internet, in a manner that is readily accessible to all jurisdictions and to the public, all information about each sex offender* in the registry. The jurisdiction shall maintain the Internet site in a manner that will permit the public to obtain relevant information for each sex offender by a single query for any given zip code or geographic radius set by the user. The jurisdiction shall also include in the design of its Internet site all field search capabilities needed for full participation in the Dru Sjodin National Sex Offender Public Website and shall participate in that website as provided by the Attorney General.
A jurisdiction shall exempt from disclosure—
the identity of any victim of a sex offense*;
the Social Security number of the sex offender;
any reference to arrests of the sex offender that did not result in conviction; and
any other information exempted from disclosure by the Attorney General.
A jurisdiction may exempt from disclosure—
any information about a tier I sex offender* convicted of an offense other than a specified offense against a minor*;
the name of an employer of the sex offender;
the name of an educational institution where the sex offender is a student*; and
any other information exempted from disclosure by the Attorney General.
The site shall include, to the extent practicable, links to sex offender safety and education resources.
The site shall include instructions on how to seek correction of information that an individual contends is erroneous.
The site shall include a warning that information on the site should not be used to unlawfully injure, harass, or commit a crime against any individual named in the registry or residing or working at any reported address. The warning shall note that any such action could result in civil or criminal penalties.
