If an agency decides not to fully reinvestigate, it doesn't have to review the case again for five years. The same five-year wait applies after a full reinvestigation that doesn't identify a suspect. Major new evidence can restart the process early.
(a) Case file review. If an agency* reviews a case file and decides not to conduct a full reinvestigation, this chapter does not require another case file review of that same cold case murder* for five years — unless newly discovered, materially significant evidence turns up. The agency may still keep investigating on its own, even without a new application from a designated person*.
(b) Full reinvestigation. If a full reinvestigation is completed and no suspect is identified by the end of it, no further case file review or full reinvestigation of that same cold case murder* is required for five years from the date the reinvestigation concluded — again, unless newly discovered, materially significant evidence turns up.
If a review under subsection (a) case file 1 regarding a cold case murder* is conducted and a conclusion is reached not to conduct a full reinvestigation, no additional case file review shall be required to be undertaken under this chapter with respect to that cold case murder* for a period of five years, unless there is newly discovered, materially significant evidence. An agency* may continue an investigation absent a designated person’s application.
If a full reinvestigation of a cold case murder is completed and a suspect is not identified at its conclusion, no additional case file review or full reinvestigation shall be undertaken with regard to that cold case murder for a period of five years beginning on the date of the conclusion of the reinvestigation, unless there is newly discovered, materially significant evidence.
