38 U.S.C. § 112Presidential memorial certificate program

submitted 61 years ago by Pub. L. 89-88 to r/title-38-VETERANS-BENEFITS · 162 words · no verdicts yet

in plain englishAI-generated · not legal advice

This law lets the VA Secretary, at the President's request, send memorial certificates honoring deceased veterans eligible for burial in a national cemetery. Multiple eligible people can each receive a certificate, but the program can't cover certain excluded deaths.

(a) At the President's request, the Secretary may run a program honoring the memory of deceased people eligible for national cemetery burial under section 2402(a)(1), (2), (3), or (7). The Secretary sends eligible recipients a certificate signed by the President, expressing the country's gratitude for the deceased's military service. Giving a certificate to one eligible recipient doesn't stop another eligible recipient from also getting one if they ask. (b) An "eligible recipient" means the next of kin, or — if they ask — a relative, friend, or authorized service representative acting for that relative or friend. (c) No certificate can be issued under this program for a deceased person described in section 2411(b).

(a)

At the request of the President the Secretary may conduct a program for honoring the memory of deceased persons eligible for burial in a national cemetery by reason of any of paragraphs (1), (2), (3), or (7) of section 2402(a) of this title, by preparing and sending to eligible recipients a certificate bearing the signature of the President and expressing the country’s grateful recognition of the deceased individual’s service in the Armed Forces. The award of a certificate to one eligible recipient will not preclude authorization of another certificate if a request is received from some other eligible recipient.

(b)

For the purpose of this section an “eligible recipient” means the next of kin, a relative or friend upon request, or an authorized service representative acting on behalf of such relative or friend.

(c)

A certificate may not be furnished under the program under subsection (a) on behalf of a deceased person described in section 2411(b) of this title.
