submitted 25 years ago by Pub. L. 107-95 to r/title-38-VETERANS-BENEFITS · 363 words · no verdicts yet
The Secretaries of Veterans Affairs and Labor must run referral and counseling services for eligible veterans leaving penal or long-term mental-health institutions. The program must operate in at least 12 locations and may use grants.
(a) Program authority. The Secretary* of Veterans Affairs and the Secretary of Labor, called the “Secretaries” in this section, must run a program of referral and counseling services for eligible veterans. The services concern benefits and services available under this title and under State* law.
(b) Program locations. The program must operate in at least 12 locations. One location must be a penal institution under the Bureau of Prisons.
(c) Program scope. (1) As far as practicable, the program must provide both referral and counseling services. Counseling must cover job training and placement, including job readiness, housing, health care, and other benefits that help an eligible veteran* move from institutional living.
(2)(A) When services are provided at a program location, referral services must be provided in person during a period set by the Secretaries that comes before the eligible veteran’s release or discharge. Counseling services must be provided after that date. (B) As part of the program, the Secretaries may give penal-institution officials outreach information about referral and counseling services. The officials may present it to veterans in their custody during the 18 months before the veteran’s release or discharge.
(3) The Secretaries may make grants to entities or organizations that meet requirements established by the Secretaries, so those entities or organizations can provide the required services.
(4) In developing the program, the Secretaries must consult Bureau of Prisons officials, officials of State penal institutions and penal institutions of State subdivisions, and any other officials the Secretaries consider suitable.
(d) Definition. In this section, “eligible veteran” means a veteran who:
(1) Lives in a penal institution or an institution providing long-term care for mental illness; and
(2) Is at risk of homelessness without the referral and counseling services provided under the demonstration program, as determined under guidelines established by the Secretaries. This section does not define “demonstration program” beyond this reference.
The Secretary* and the Secretary of Labor (hereinafter in this section referred to as the “Secretaries”) shall carry out a program of referral and counseling services to eligible veterans with respect to benefits and services available to such veterans under this title and under State* law.
The program shall be carried out in at least 12 locations. One location shall be a penal institution under the jurisdiction of the Bureau of Prisons.
To the extent practicable, the program shall provide both referral and counseling services, and in the case of counseling services, shall include counseling with respect to job training and placement (including job readiness), housing, health care, and other benefits to assist the eligible veteran* in the transition from institutional living.
To the extent that referral or counseling services are provided at a location under the program, referral services shall be provided in person during such period of time that the Secretaries may specify that precedes the date of release or discharge of the eligible veteran, and counseling services shall be furnished after such date.
The Secretaries may, as part of the program, furnish to officials of penal institutions outreach information with respect to referral and counseling services for presentation to veterans in the custody of such officials during the 18-month period that precedes such date of release or discharge.
The Secretaries may make grants to carry out the referral and counseling services required under the program with entities or organizations that meet such requirements as the Secretaries may establish.
In developing the program, the Secretaries shall consult with officials of the Bureau of Prisons, officials of penal institutions of States and political subdivisions of States, and such other officials as the Secretaries determine appropriate.
In this section, the term “eligible veteran” means a veteran who—
is a resident of a penal institution or an institution that provides long-term care for mental illness; and
is at risk for homelessness absent referral and counseling services provided under the demonstration program (as determined under guidelines established by the Secretaries).
