38 U.S.C. § 3564 — Annual adjustment of amounts of educational assistance

For each fiscal year, educational-assistance rates increase by the corresponding increase in the Consumer Price Index. The section sets different dollar-rounding rules for fiscal years after 2004 and before 2014, and after 2013.
(a) For each fiscal year, the Secretary* must increase rates under sections 3532, 3534(b), and 3542(a) by the percentage increase in the Consumer Price Index for all items, United States city average. The comparison is between the 12 months ending June 30 before the fiscal year begins and the 12 months immediately before that period: (1) the first period's index exceeds (2) the earlier period's index by that percentage. (b) For fiscal years after 2004 and before 2014, the increase is rounded down to the next lower whole dollar. For fiscal years after 2013, it is rounded to the nearest whole dollar.
With respect to any fiscal year, the Secretary* shall provide a percentage increase in the rates payable under sections 3532, 3534(b), and 3542(a) of this title equal to the percentage by which—
the Consumer Price Index (all items, United States city average) for the 12-month period ending on the June 30 preceding the beginning of the fiscal year for which the increase is made, exceeds
such Consumer Price Index for the 12-month period preceding the 12-month period described in paragraph (1).
Any increase under subsection (a) in a rate with respect to a fiscal year after fiscal year 2004 and before fiscal year 2014 shall be rounded down to the next lower whole dollar amount. Any such increase with respect to a fiscal year after fiscal year 2013 shall be rounded to the nearest whole dollar amount.
