38 U.S.C. § 728 — Misuse of Department purchase cards

The Secretary must bar an employee found to have knowingly misused a Department purchase card from being a cardholder or approving official. Misuse includes splitting purchases, exceeding limits, unauthorized purchases or use, and ethics violations.
(a) General. (1) The Secretary* must prohibit an employee whom the Secretary or Department* Inspector General finds knowingly misused a purchase card from serving as a purchase-card holder or approving official. (2) This is in addition to any other penalty. (b) Misuse. “Misuse” means (1) splitting purchases; (2) exceeding purchase-card limits or thresholds; (3) buying an unauthorized item; (4) using a card without being an authorized holder; or (5) violating ethics standards. This section does not define “purchase card,” “purchase-card holder,” or “approving official.”
The Secretary* shall prohibit any employee of the Department* who the Secretary or the Inspector General of the Department determines has knowingly misused a purchase card from serving as a purchase card holder or approving official.
Such a prohibition shall be in addition to any other applicable penalty.
For purposes of this section, the term “misuse” means—
splitting purchases;
exceeding applicable purchase card limits or purchase thresholds;
purchasing any unauthorized item;
using a purchase card without being an authorized purchase card holder; or
violating ethics standards.
