The Appalachian Regional Commission needs the Federal Cochairman's vote plus a majority of state members to approve decisions. The Federal Cochairman must consult interested federal agencies where practical. Some major decisions and project approvals need a quorum or follow separate procedures.
(a) Requirements for Approval. Except as section 14306(d) provides otherwise, a Commission decision needs both the Federal Cochairman's yes vote and a majority yes vote from state members. States that are delinquent under section 14306(d) do not count toward that majority.
(b) Consultation. When a matter comes before the Commission, the Federal Cochairman must, as much as is practical, consult with the federal agencies interested in the subject.
(c) Decisions Requiring Quorum of State Members. The Commission cannot decide matters of Commission policy, approve state or regional development plans or strategy statements, change the Appalachian Regional Commission Code, allocate funds among states, or designate a distressed or economically strong county, unless a quorum of state members is present.
(d) Project and Grant Proposals. The Commission is responsible for approving project and grant proposals, and must do so following the process in section 14322.
Except as provided in section 14306(d) of this title, decisions by the Appalachian Regional Commission require the affirmative vote of the Federal Cochairman and of a majority of the state members, exclusive of members representing States delinquent under section 14306(d).
In matters coming before the Commission, the Federal Cochairman, to the extent practicable, shall consult with the federal departments and agencies having an interest in the subject matter.
A decision involving Commission policy, approval of state, regional or subregional development plans or strategy statements, modification or revision of the Appalachian Regional Commission Code, allocation of amounts among the States, or designation of a distressed county or an economically strong county shall not be made without a quorum of state members.
The approval of project and grant proposals is a responsibility of the Commission and shall be carried out in accordance with section 14322 of this title.
