41 U.S.C. § 113 — Responsible source

This law defines a "responsible source" for federal contracting — a company qualified to win a government contract. It must have the money, ability, track record, and equipment, or the ability to get them, to do the job properly and honestly.
In this subtitle, a "responsible source" is a prospective contractor who: (1) has enough financial resources to perform the contract, or can get them; (2) can meet the required or proposed delivery or performance schedule, taking into account its other existing business commitments; (3) has a satisfactory record of performance; (4) has a satisfactory record of integrity and business ethics; (5) has the organization, experience, accounting and operational controls, and technical skills needed — or can get them; (6) has the production, construction, and technical equipment and facilities needed — or can get them; and (7) is otherwise qualified and eligible for an award under the applicable laws and regulations.
In this subtitle, the term “responsible source” means a prospective contractor that—
has adequate financial resources to perform the contract or the ability to obtain those resources;
is able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and Government business commitments;
has a satisfactory performance record;
has a satisfactory record of integrity and business ethics;
has the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain the organization, experience, controls, and skills;
has the necessary production, construction, and technical equipment and facilities, or the ability to obtain the equipment and facilities; and
is otherwise qualified and eligible to receive an award under applicable laws and regulations.
